Radestrian criminal law (Radestrian: dai stjátenișe a rredeșeșe) is the set of laws in Radestria regarding offences punishable by the state, as outlined in the Stjásdraus, the Radestrian penal code (SD).

Definitions

Criminal offence (§ 1 SD)

Stjásdes:

  1. hai rívug-aș, vasta gjeș stjásurru a Fvans.
  2. voí rívud ryetsișt hvoltș aniest, vasta gjeș-te hvoltș strjácat.

A criminal offence:

  1. is a type of offence punishable by the State.
  2. can only refer to a triable offence for which one can be convicted.

Some offences are not triable as they refer to groups of criminal offences, from which one must be determined in order to convict, e.g. homicide.

Scope of effect

Dzathes huas; akautthas huas (§ 2 SD)

  1. A Fvans irá Daist hjeaș hvolta stjásurrut.
  2. Des ir stjásdest anerșeș daist hjeaș hvolta stjásurruruot.
  1. The State cannot punish without the Law.
  2. An act cannot be punished without a law defining the criminal offence.

The Kirvic phrase dzathes hūas; akautthas hūas means “(if there is) no law, (there is) no penalty”. It is equivalent to the Latin nulla poena sine lege. In Radestrian, the phrase is translated as stjásg hjeaș ir daist “(there is) no punishment without law”.

Crimes committed in Radestria (§ 3 SD)

Ádeș stjásdes lá Rredeșen anerastrú, redvemș dai a rredeșeșe.

If a criminal offence is committed in Radestria, Radestrian law applies.
